These terms apply to anyone who signs in to PWRFULLY Studio ("Studio") or connects an account to it. Studio is run by Mina Amso, trading as PWRFULLY, in Auckland, New Zealand ("we", "us"). By using Studio you agree to these terms and to the PWRFULLY Studio privacy policy.
What Studio is
Studio is a private tool for planning, making and publishing PWRFULLY's own content: clips from podcast episodes, captions, and scheduled posts to YouTube, Instagram, LinkedIn and TikTok. It is not offered to the public. Access is by invitation from Mina Amso only.
Access and sign-in
- Only people Mina invites can sign in, with a link sent to their email address. Keep access to that email address secure, and tell us straight away if you think someone else has used it.
- Each person is an owner, an editor or a viewer. The owner can change a person's role or remove their access at any time.
- Only connect accounts you own or are authorised to manage. Connecting an account authorises Studio to act on that account as described in the privacy policy, until you disconnect it.
Acceptable use
When using Studio you must not:
- post anything unlawful, defamatory, harassing, misleading or that infringes someone else's rights;
- post content you do not have the rights or permission to use, including clips from another person's show without the host's permission and credit;
- send spam, or use Studio in a way that breaks any platform's rules, limits or terms;
- try to get around Studio's security, reach information you are not allowed to see, or copy, reverse-engineer or overload Studio;
- use Studio to download content a platform does not allow to be downloaded.
Your content and what you post
You keep ownership of the content you put into Studio. You give us permission to store, process and send it only as needed to run Studio for you.
You are responsible for everything you publish through Studio, including captions, music, and the consent of anyone who appears in it. Studio's AI suggestions (clip moments, headlines, captions, hashtags and tags) are drafts: check them before they go out. Studio publishes what you schedule, but each platform decides whether, when and how a post appears, and may refuse, delay or remove it.
Changes, suspension and ending
We may change, suspend or stop Studio, or end anyone's access, at any time. You can stop using Studio and disconnect your accounts at any time. When access ends, information is kept or deleted as the privacy policy describes.
No warranty
Studio is provided "as is" and "as available". We do not promise it will always be available, free of errors, or that every scheduled post will be published on time. Studio is provided for business purposes, so to the extent the law allows, the Consumer Guarantees Act 1993 does not apply.
Liability
To the extent the law allows, we are not liable for any indirect or consequential loss, lost content, lost profits, missed or failed posts, or anything a platform does to your account or posts. Our total liability for any claim about Studio is limited to the amount, if any, you have paid us for Studio.
Governing law
These terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction.
Changes to these terms
We may update these terms. The date at the top shows when they last changed. Using Studio after a change means you accept the updated terms.
